Legal & Privacy

Effective April 1, 2009. Last updated August 24, 2026.

Terms of Service

By accessing or using AVIATOR, you agree to these Terms of Service. If you do not agree, do not use the service. AVIATOR may update these terms, product features, pricing, and service availability. Continued use after an update constitutes acceptance where permitted by law.

AVIATOR provides commercial aviation news, research, company and aircraft information, market indicators, monitoring configuration, alerts, newsletters, and related intelligence tools. Features and coverage may vary by access level and data availability.

Accounts, Workspaces & Security

You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access. Each person should use a named login; shared generic credentials are prohibited.

Enterprise permits unlimited internal users employed by the subscribing legal entity. It does not automatically extend to affiliates, customers, advisors, portfolio companies, or other external organizations. Organization owners and administrators are responsible for granting and removing access appropriately.

Some administrative functions require multi-factor authentication. AVIATOR may suspend access where needed to protect the service, data, customers, or third parties.

Subscriptions, Billing & Renewal

Paid access

Unless separately invoiced or stated in a written agreement, paid subscriptions renew automatically for the same billing interval until canceled. AVIATOR intends to provide renewal notice at least seven days before renewal where operationally practicable.

PRO may be offered monthly or annually. New Enterprise subscriptions are annual. Beacon is separately contracted and is not automatically included with PRO or Enterprise. Legacy and custom plans may remain grandfathered under their existing commercial terms and may not be available for new purchase.

Cancellation prevents future renewal but does not ordinarily create a refund for the current paid period. Failed or overdue payments may result in restricted access. Taxes, where applicable, are the customer's responsibility.

Beacon & Third-Party Data Providers

Beacon is a monitoring and alerting aid, not an air-traffic-control, dispatch, safety, maintenance, emergency, or operational-control system. Aircraft positions, events, tracks, airport information, airspace information, and related data may be delayed, incomplete, inaccurate, unavailable, or affected by provider coverage.

Pilot pricing, aircraft capacity, provider-credit budgets, endpoint availability, polling intervals, stored-track availability, and alert capabilities may change during validation. Large fleets, API access, redistribution, or unusual usage require separate written terms.

Never rely on AVIATOR or Beacon for safety-of-flight, emergency response, regulatory compliance, aircraft control, maintenance release, or other time-critical operational decisions.

Intelligence, Sources & Accuracy

AVIATOR works to use verified data and visible sources, but aviation news, company relationships, fleet records, executive information, market indicators, aircraft values, alerts, and third-party data can be incomplete, delayed, estimated, or incorrect. Empty or unavailable data does not imply that no relevant activity exists.

Aircraft CMV and CBV information is contextual market intelligence, not a certified appraisal or valuation opinion. Macro data and other indicators may be revised by their original publishers.

You are responsible for verifying material information with original sources and qualified professionals before making investment, financing, legal, accounting, tax, safety, maintenance, commercial, or operational decisions.

Permitted Use, Copyright & Restrictions

AVIATOR content, presentation, databases, compilation, software, branding, and original analysis are protected by copyright and other applicable rights. A paid subscription permits authorized internal business use by the applicable user or subscribing organization.

You may not copy, republish, distribute, scrape, resell, sublicense, create a competing database from, or otherwise commercially exploit AVIATOR content or data outside the subscribing organization without prior written consent.

You may not bypass access controls, share accounts, interfere with the service, probe security, use automated extraction without permission, misrepresent AVIATOR data as your own, or use the service unlawfully. API access, syndication, licensing, and redistribution require separate written authorization.

Important Disclaimer

AVIATOR is an aviation intelligence and organizational service. It does not provide investment, securities, legal, accounting, tax, appraisal, safety, maintenance, engineering, dispatch, or operational-control advice.

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. AVIATOR does not guarantee uninterrupted access, alert delivery, data completeness, source availability, or any particular commercial result.

Limitation of Liability

To the maximum extent permitted by law, AVIATOR and its owner, operators, affiliates, officers, employees, contractors, licensors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from inaccurate or delayed information, missed or failed alerts, unavailable services, provider failures, data loss, business interruption, lost profits, or decisions made in reliance on the service.

Nothing in these terms excludes liability that cannot lawfully be excluded.

Privacy Policy

AVIATOR also processes technical information necessary to operate and protect the service, such as authentication sessions, timestamps, request metadata, provider usage, error information, and limited first-party product-event data.

How Information Is Used

Information is used to provide and secure accounts, deliver subscribed features, process payments, manage billing and entitlements, send requested newsletters and alerts, respond to support requests, prevent abuse, maintain audit history, improve the product, and comply with law.

Service Providers & Disclosure

Depending on the deployed feature, information may be processed by service providers supporting hosting, database, authentication, payments, accounting, email, analytics, DNS/security, customer communications, and aviation data. These may include Vercel, Supabase, Stripe, QuickBooks, Gmail or Google services, Google Analytics, Cloudflare, 101domain, Sendy, Amazon SES, and contracted aviation-data providers.

Service providers receive information only as needed for their functions and under their applicable terms. Information may also be disclosed when required by law, valid legal process, or to protect rights, security, users, or the public.

Customer Recipients, Shared Access & Data Control

Enterprise administrators who add newsletter or alert recipients represent that they are authorized to use those addresses for the selected business communications. Organization administrators are responsible for member access and for removing access when employment or authorization ends.

Users may update eligible account information, change security settings, unsubscribe recipients, and request account deletion through available controls. Certain billing, audit, security, and legal records may be retained where necessary for legitimate operations, fraud prevention, dispute resolution, or legal obligations.

Security, Retention & External Links

AVIATOR uses access controls, row-level security, protected server operations, administrative MFA, and other safeguards appropriate to the service. No internet service can guarantee absolute security.

Information is retained for as long as reasonably necessary to provide the service, maintain required business and security records, resolve disputes, and comply with law. Source links and other external sites are governed by their own terms and privacy practices.

Governing Law & Contact

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Venue for disputes will lie in Hays County, Texas, except where applicable law requires otherwise.

Questions about these terms, privacy practices, access, correction, or deletion may be sent to AVIATOR through the contact page or to info@aviator.aero.
